Environmental Protection have been consulted on the submitted information and raise no objection. The details within the submitted report: Spectrum Acoustic Consultants, Noise Assessment for a Proposed Residential Development, Land off Phoenix Parkway Scunthorpe, DN15 8RA Report ref. RK3048/20396/Rev 4. Dated 10.09.21 are acceptable to the council and subject to the implementation of the agreed mitigation measures set out below including the typical sound insulation specification for the dwellings set out in Table 3 of the submitted report, this condition is discharged:
Plots 1-2, 8-9, 19-30, 59-71, 127 and 138-146:
Acoustic performances in habitable rooms within the plots closest to Phoenix Parkway can typically be achieved by the following specification.
- Standard double glazed unit (rated Rw+Ctr 25dB), typically comprising of 4mm float glass, 12mm cavity, 4mm float glass.
- Acoustic trickle ventilators (rated at Dn,e,w + Ctr 42dB).
All of the other remaining plots:

Condition 31.
No dwelling shall be occupied until details of a noise mitigation scheme have beensubmitted to and approved in writing by the local planning authority. As a minimumthis noise mitigation scheme shall include details of:

- details of noise mitigation measures;

- predicted noise levels to be achieved at sensitive locations as a result of the noise mitigation scheme;

- details of how the noise mitigation scheme will be maintained for the lifetimeof the development;

- the noise mitigation scheme shall be implemented before occupation of thedevelopment and shall be retained thereafter.

The council's ecologist has been consulted on the amended Species Protection Plan and Biodiversity Management Plan with Metric 3.1 Assessment dated January 2023 and recommends that the condition is discharged. This condition is discharged on the basis of the amended Species Protection Plan and Biodiversity Management Plan with Metric 3.1 Assessment dated January 2023 Version No. 2 by SLR.

Condition 41.
Within three months of the commencement of development, the applicant or theirsuccessor in title shall submit a biodiversity metric assessment and biodiversitymanagement plan to the local planning authority for approval in writing.The plan shall include:

(a) prescriptions for the installation of bat bricks or bat boxes on 10% of newdwellings, concentrating on those nearest to Atkinson's Warren LNR;

(b) prescriptions for the installation of swift bricks on 10% of new dwellings and batboxes and nest boxes on retained trees and hedgerows;

(c) details of wetland habitat to be created as part of a sustainable urban drainagesystem;

(d) prescriptions for landscaping using trees, shrubs and hedge plants of highbiodiversity value;

(e) prescriptions for the creation of a landscape buffer shown on drawing no 3026-1-001 H (proposed) site layout around Atkinson's Warren LNR, comprising treeand shrub species recorded in the nearby hedgerows and woodland.

(f) restrictions on external lighting to avoid impacts on bat roosts, bat foragingareas and sensitive habitats;

(g) provision for hedgehogs to pass through any fencing installed between gardensand between areas of grassland;

(h) appropriate phasing mechanisms to ensure that significant areas of habitat arecreated and are becoming properly established before each phase ofconstruction;

(i) procedures for monitoring and ongoing management of created habitats;

(j) measures to avoid light, noise and water pollution, fly-tipping and other factorsthat would harm habitats and species;

(k) prescriptions for the provision of a wildlife gardening leaflet for each newresident;

(l) proposed timings for the above works in relation to the completion of thedwellings.

The penultimate dwelling on site shall not be occupied until the access roads havebeen completed.

All the approved landscaping shall be carried out within eighteen months ofdevelopment being commenced (unless a longer period is agreed in writing by thelocal planning authority). Any trees or plants which die, are removed or becomeseriously damaged or diseased within five years from the date of planting shall bereplaced in the next planting season with others of similar size and species to thoseoriginally required to be planted, unless the local planning authority agrees in writingto any variation.

Condition 26.
No development shall take place until a scheme for the disposal of foul water has beenagreed in writing by the local planning authority and none of the dwellings shall beoccupied until it is connected to the approved drainage system.

HER have been consulted on the works and recommend that the condition is discharged. Condition 38.
The development shall not be occupied until the site investigation and post excavationassessment has been completed in accordance with the programme set out in theapproved archaeological mitigation strategy, and provision secured for the subsequentanalysis, publication and dissemination of results and archive deposition, to beapproved by the local planning authority.

No dwelling on the site shall be occupied until the access road has been completed toat least base course level and adequately lit from the junction with the adjacenthighway up to the access to the dwelling.

Condition 27.
Before development commences on site, details of all the finished floor levels at whichall the dwellings will be constructed and the details of the levels of the embankmentson the site, which shall include the submission of a cross section(s) east to west acrossthe site, shall be submitted to and approved in writing by the local planning authority.Only the approved scheme shall be implemented on the site.
Historic Environment Record have been consulted on the submitted information and raise no objections. The condition is discharged based on the submitted Written Scheme of Investigation (WSI)SLR Ref: 403.03044.00199 Version No: 2 May 2021.(Previously discharged on 14/07/2022) Condition 37.
The applicant, or their agents or successors in title, shall submit the following detailsto the planning authority for their written approval at least six weeks prior to thecommencement of archaeological work:

(i)evidence that a contract has been enteredinto with an archaeological contractor to undertake all stages of the archaeologicalmitigation programme

(ii) a timetable that provides sufficient notification and allowanceof time to ensure the completion of the archaeological site work ahead of constructioncommencing

10.

No dwelling on the site shall be occupied until the private driveway has been completed, to a standard to be agreed beforehand in writing with the local planning authority, up to its junction with the vehicular access to that dwelling.

Condition 23.
No development shall take place until a detailed surface water drainage scheme forthe site has been submitted to and approved in writing by the local planning authority.The scheme shall be based on sustainable drainage principles and an assessment ofthe hydrological and hydro-geological context of the development. This must be basedupon the submitted Flood Risk Assessment, prepared by JOC Consultants Ltd, ReportNo: 20/029/01, Revision : 01, Dated: 09 June 2021. and Drainage Layout, sheets 1 and 2 of 2, Drawing Nos: 21/735/9931B & 21/735/993sB.

The drainage scheme shall demonstrate that surface water run-off generated up toand including the 1 in 100 year critical storm (including an allowance for climatechange which should be based on the current national guidance will not exceed therun-off from the existing site. It shall also include details of how the resulting completedscheme is to be maintained and managed for the lifetime of the development so thatflood risk, both on and off the site, is not increased. SuDS must be considered.Reference should be made to North Lincolnshire Council's SuDS and Flood RiskGuidance Document. Should infiltration not be feasible at the site, alternativesustainable drainage should be used, focusing on above-ground solutions.

The drainage scheme shall be implemented in accordance with the approvedsubmitted details required by the above condition (condition number 23) and shall becompleted prior to the occupation of any dwelling or building within each phase or sub-phase of the development on site and thereafter retained and maintained inaccordance with the scheme for the life of the development unless otherwise agreedin writing with the local planning authority.

Condition 25.
No development shall take place until details showing an effective method ofpreventing surface water run-off from the highway onto the developed site have been submittedto and approved in writing by the local planning authority. These facilities shall beimplemented prior to the access and parking facilities being brought into use andthereafter so retained.

Environmental Protection have been consulted on the proposals and recommend the condition be discharged. 32.

Prior to the occupation of the development, an acoustic barrier or masonry wall shall be erected on site. A detailed technical specification of the acoustic barrier or wall shall be submitted to and approved in writing by the local planning authority. The specification shall include details of the location, size and design of the barrier, with predicted noise reduction over the frequency spectrum. The approved acoustic barrier or wall shall be installed prior to occupation of any dwelling on the site and shall be maintained thereafter.

No dwelling on the site shall be occupied until the vehicular access to it and the vehicleparking spaces serving it have been completed and, once provided, the vehicleparking spaces shall be retained.

Condition 13.
No development shall begin until details of:

(i) the layout, drainage, construction, services and lighting of the proposedaccess road, including the junction with the adjacent highway; and

(ii) the number and location of vehicle parking space(s) on the site;

have been submitted to and approved in writing by the local planningauthority.
The submitted details are acceptable to the council. This condition is discharged on the basis of drawing no: Materials layout 3129-01-01.(Previously discharged on 14/07/2022) Condition 28.
No above-ground works shall take place until a full schedule of the external materialsfor all the dwellings to be constructed on the site have been submitted to and approvedin writing by the local planning authority. Thereafter only the approved materials shallbe used on the dwellings.
[Compliance condition] Condition 7.
Notwithstanding the provisions of the Town and Country Planning (General PermittedDevelopment) Order 2015 (or any order revoking and re-enacting that order with orwithout modification), nothing shall at any time be erected, retained, planted or allowedto grow over 1.05 metres in height above the level of the adjoining carriageway for adistance of 2 metres from the highway boundary across the site frontage.

Condition 6.
No loose material shall be placed on any driveway or parking area within 10 metres ofthe adopted highway unless measures are taken in accordance with details to besubmitted to and approved in writing by the local planning authority to prevent thematerial from spilling onto the highway. Once agreed and implemented thesemeasures shall be retained.

The condition is discharged on the basis of the following information: Play area design ref 2308.39807, proposed play area design and agent's email dated 19/10/2023. Only the approved scheme shall be implemented on the site.

Condition 29.
Before any above-ground works take place on the site, details of the design, locationand layout of the open space and the Local Equipped Area of Play shall be submittedto and agreed in writing with the local planning authority. Thereafter only the approvedscheme shall be implemented on the site.

The council's ecologist has been consulted on the amended Species Protection Plan and Biodiversity Management Plan dated January 2023 and recommends that the condition is discharged. This condition is discharged on the basis of the amended Species Protection Plan and Biodiversity Management Plan with Metric 3.1 Assessment dated January 2023 Version No. 2 by SLR.

Condition 40.
No development shall take place until a species protection plan has been submittedto and approved in writing by the local planning authority.The plan shall include:

(a) details of sensitive working practices to avoid harm to reptiles, amphibians,bats, badgers, hedgehogs and nesting birds;

(b) details of road gullies and road drainage designed to minimise harm toamphibians.
[Compliance condition] Condition 15.
No other works shall be commenced on the site until the access road junction with theadjacent highway, including the required visibility splays, has been set out andestablished.
[Compliance condition] Condition 16.
Once established, the visibility splays shall be at all times be maintained.
Environmental Protection have been consulted on the amended CEMP received on 31/08/2022 and recommend that the condition is discharged. This condition is hereby discharged on the basis of the amended CEMP received on 31/08/2022. Condition 33.
No stage of the development hereby permitted shall commence until a construction environmental management plan (CEMP) has been submitted to and approved inwriting by the local planning authority. The CEMP shall include the following:

Noise and vibration: The CEMP shall set out the particulars of –

(a) the works, and the method by which they are to be carried out;

(b) the noise and vibration attenuation measures to be taken to minimise noise andvibration resulting from the works, including any noise limits; and

(c) a scheme for monitoring the noise and vibration during the works to ensurecompliance with the noise limits and the effectiveness of the attenuationmeasures.

Light: The CEMP shall set out the particulars of –

(a) specified locations for contractors’ compounds and materials storage areas;

(b) areas where lighting will be required for health and safety purposes;

(c) location of potential temporary floodlights;

(d) identification of sensitive receptors likely to be impacted upon by light nuisance;

(e) proposed methods of mitigation against potential light nuisance, includingpotential glare and light spill, on sensitive receptors.

Dust: The CEMP shall set out the particulars of –

(a) site dust monitoring, recording and complaint investigation procedures;

(b) identification of receptors and the related risk of dust impact at all phases of thedevelopment, including when buildings and properties start to be occupied;

(c) provision of water to the site;

(d) dust mitigation techniques at all stages of development;

(e) prevention of dust trackout;

(f) communication with residents and other receptors;

(g) a commitment to cease the relevant operation if dust emissions are identifiedeither by regular site monitoring or by the local authority;

(h) a 'no burning of waste' policy.
This is a compliance condition. This condition cannot be discharged until the post excavation programme of work set out in the submitted WSI has been completed in full. Condition 36.
Development shall take place in accordance with the archaeological mitigationstrategy ‘Land off Phoenix Parkway, Scunthorpe, North Lincolnshire, Written Schemeof Investigation for Archaeological Mitigation, SLR, v2 May 2021’, and the approveddetails and timings.

Condition

20.

The final travel plan shall be submitted to and approved in writing by the local planning authority within six months of the proposed development being brought into use and all conditions and requirements of the plan, once approved, shall be implemented and retained at all times.

No development shall take place until details showing the provision of a footway onPhoenix Avenue which include how it links to the existing footway onto PhoenixParkway, have been submitted and approved in writing by the local planning authority.Thereafter only the approved scheme shall be implemented on the site and retained.
The council's tree officer has been consulted on the submitted information and raises no objection. This condition is discharged on the basis of drawing of the existing trees 3704/1 and the submitted tree report.(Previously discharged on 14/07/2022) Condition 46.
Before development is commenced, details of the method of protecting the existingtrees to be retained on the site throughout the construction period shall be submittedto and approved in writing by the local planning authority, and such works as may beso approved shall be carried out before development is commenced, and maintaineduntil completion of the development. None of the trees so protected shall be wilfullydamaged or destroyed, uprooted, felled, lopped or topped, nor any other works carriedout which would cause damage to the root systems or otherwise threaten the lives ofthe trees during the period of construction without the previous written consent of thelocal planning authority. Any trees removed without such consent or dying or beingseverely damaged or becoming seriously diseased during that period shall be replacedwith trees of such size and species as may be agreed with the local planning authority.

12.

Works shall not commence on site until wheel cleaning facilities, in accordance with details to be submitted to and approved in writing by the local planning authority, have been provided within the curtilage of the site, and this facility shall be retained for the duration of the works.

Environmental Protection have been consulted on the proposals and recommend that the condition is discharged. This condition is discharged based on the information submitted in the supporting letter submitted by Gleesons.The approved scheme shall be installed in full and retained in perpetuity thereafter.(Previously discharged on 14/07/2022) Condition 34.
A scheme for the provision of electrical vehicle charging points shall be submitted toand approved in writing by the local planning authority. The scheme shall be designedto take account of good practice guidance as set out in the Institute of Air QualityManagement Land Use Planning and Development Control: http://www.iaqm.co.uk/text/guidance/air-qualityplanning-guidance.pdf andcontemporaneous electrical standards including:

- Electrical Requirements of BS7671:2008;

- IET Code of Practice on Electrical Vehicle Charging Equipment installation2012 ISBN 978-1-84919-515-7.

The approved scheme shall be installed in full and retained in perpetuity thereafter.

Condition 22.
No development shall take place until a construction phase traffic management planshowing details of:

(i) a pre/post construction condition survey of the carriageway to identify anydefects and how they will be rectified;

(ii) all associated traffic movements, including delivery vehicles andstaff/construction movements;

(iii) any abnormal load movements;

(iv) contractor parking and welfare facilities;

(v) storage of materials; and

(vi) traffic management requirements, including the means of controlling thedeposition of mud onto the adjacent highway, along with appropriatemethods of cleaning the highway, as may be required;

Condition 9.
No dwelling served by the private driveway shall be occupied until it has beenconstructed in accordance with details including:

(i) the proposed method of forming access from the highway, including therequired visibility splays;

(ii) the method of constructing/paving the drive;

(iii) the provision of adequate drainage features;

(iv) the provision of suitable bin collection facilities adjacent to the highway;

(v) the provision of suitable lighting arrangements; and

(vi) the provision of street name plates that shall include the words 'PrivateDrive';

The biodiversity management plan and species protection plan shall be carried out in accordance with the approved details and timings, and the approved features shall be retained thereafter, unless otherwise approved in writing by the local planning authority. Prior to the occupation of the 77th and 155th dwellings hereby approved, the applicant or their successor in title shall submit a report to the local planning authority, providing evidence of compliance with the biodiversity management plan and species protection plan.

The travel plan, once approved and in place, shall be subject to monitoring on anannual basis for a period of three years from the approval date. The monitoring reporton the impact of the travel plan shall be submitted to the local planning authority onthe first of January each year following the grant of planning permission. Allamendments to the approved travel plan identified as a result of the monitoringprocess shall be implemented and retained.
